Colorado Restaurant Closed by State is Suing Governor Jared Polis
The owners of a Castle Rock restaurant that was closed for ignoring social distancing rules are suing Governor Jared Polis and the State of Colorado.
April and Jesse Arellano are the owners of C&C Breakfast and Korean Kitchen in Castle Rock. Recently, they decided to disobey the COVID-19 ruling closing restaurants for dine-in service. A video surfaced online showing a lot of people inside the establishment, most of whom were not wearing masks as a line formed out the door. This action caused Governor Jared Polis to "suspend the cafe's license indefinitely."
The Arellanos' lawsuit argues that Governor Polis and the State of Colorado "arbitrarily and irrationally" picked on small businesses throughout the pandemic lockdown, causing them major financial loss over "what only can be deemed a speculative concern" about the COVID-19 virus.
But according to Denver 7, not only are the couple claiming financial loss, but the lawsuit also states that the Colorado Disaster Emergency Relief Act does not give the governor the power to "designate and discriminate among various types of citizens and business for selective imposition of emergency orders."
